Somali marriage in Canada

In Canada, marriage law is set by each province, not nationally. In Ontario, the worked example below, the ceremony has to be performed by an officiant the province authorises, and you need a provincial marriage licence first. A nikah is a legally valid marriage when the imam is a registered officiant there and the signed licence is returned for registration; otherwise it is a religious ceremony only.

Somalis in Canada

The 2021 Census counted 62,065 people reporting Somali ethnic origin: 55,710 with Somali as their only origin and 6,355 together with another (Statistics Canada, 2024). This is a self-reported census count, not a count of everyone with Somali family ties.

How to be legally married in Canada

  1. 1Get a valid Ontario marriage licence before the ceremony. You can apply online in some municipalities or through your municipality.
  2. 2The licence is valid for 3 months from the date it was issued.
  3. 3The ceremony must be performed by an authorised marriage officiant. Ontario recognises registered officiants, such as religious officiants, and civil officiants such as municipal clerks, judges and justices of the peace.
  4. 4Ask the imam directly whether he is a registered marriage officiant in Ontario. If he is not, the nikah is religious only and you need a civil ceremony as well.
  5. 5Immediately after the ceremony, you, your spouse, the witnesses and the officiant sign the licence. In Ontario, applicants must be 18, or 16-17 with written parental consent or a court order.

Ontario is shown because its rules are public and clear; other provinces differ, so check your own province's registrar.

Fee: municipal and provincial fees exist; the Ontario page names a $75 provincial licence fee in the context of a fee waiver. Check the current total with your municipality.

What a nikah does and does not do

Mahr and the nikah contract are religious and family agreements; how a court treats them is a legal question this page does not answer.
